Ana Estrada: A Landmark Case in Peru’s History of Euthanasia

Ana Estrada, the first person in Peru to have euthanasia approved by the state, passed away on Sunday at the age of 47. Her lawyer confirmed that she underwent a medical procedure for euthanasia after suffering from a progressive degenerative disease. According to her lawyer, Josefina Miró Quesada, Ana exercised her fundamental right to a dignified death and died on her own terms, in control of her autonomy until the end.

The medical procedure was carried out in accordance with the Dignified Death Plan and Protocol approved by state social security EsSalud, following a historic ruling in Ana’s favor issued in 2021 and ratified by the Supreme Court in 2022. The court’s authorization of euthanasia for Estrada marked a significant moment in Peru’s history as it was the first time such a decision was made in the country.

Ana had been advocating for the right to a dignified death for herself and had expressed her wishes to have control over her end-of-life decisions. She had been bedridden and on a ventilator due to a disease called polymyositis that had paralyzed most of her muscles. Despite her struggles, she continued to practice as a psychologist until her condition worsened.

In a blog titled “Ana for a dignified death,” she shared her reasons for seeking euthanasia. The court’s decision to grant her this right was based on her specific circumstances and did not pave the way for widespread euthanasia in Peru. Ana’s case was unique where the court recognized her autonomy and dignity in making this decision even though euthanasia is not legally permitted in Peru, assisting someone in ending their life is punishable by up to three years in prison.

It is worth noting that euthanasia is not legally permitted in Peru; however, Ana’s case marks an exception due to the court’s recognition of her specific circumstances and fundamental right to autonomy and dignity.
